These Terms of Service (“Terms”) govern your use of the website https://roofproexteriors.com (the “Site”) and any related services offered by RoofPro Exteriors, a division of RVA Home Services Group. By accessing or using our Site, submitting information, or contracting our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not access or use the Site or our services.

1. Who We Are

RoofPro Exteriors is part of RVA Home Services Group, serving homeowners throughout the Greater Richmond, Virginia area. We specialize in roofing, siding, and gutter installation and repair, offering expert craftsmanship, clear communication, and trusted service that protects and enhances your home from the top down. All business operations, communications, and contracts are managed under the RVA Home Services Group umbrella.

2. Scope of Services

• Roof inspections, replacements, and repairs
• Siding installation and replacement
• Gutter installation and maintenance
• Insurance claim assistance and project consultations

All work is governed by a separate written service agreement or signed proposal. Quotes provided through the Site, phone, or email are estimates only and do not constitute a binding agreement until formally executed in writing.

3. Acceptance of Terms

By using our Site or submitting any inquiry, you confirm that you:

• Are at least 18 years of age;
• Have read and understood these Terms; and
• Agree to be legally bound by them.

If you are acting on behalf of a company or property owner, you represent that you are authorized to bind that entity to these Terms.

4. Estimates, Proposals, and Service Agreements

• Initial estimates are based on limited information and may change after inspection or upon identifying hidden conditions.
• A signed service agreement is required before materials are ordered or work begins.
• Change orders or additional work must be approved in writing by the client.
• RoofPro Exteriors reserves the right to adjust pricing for changes in material costs, labor rates, or project scope.

5. Scheduling, Weather, and Access

• All scheduling is subject to weather, material availability, and crew capacity.
• Work may be postponed due to unsafe weather or unforeseen circumstances.
• The client must ensure safe access to the property and keep driveways, walkways, and work zones clear.
• RoofPro Exteriors is not liable for delays caused by conditions beyond our control.

6. Payments, Deposits, and Refunds

• Payment terms, deposit amounts, and due dates are specified in your signed service agreement.
• Deposits become non-refundable once materials are ordered or installation begins.
• RoofPro Exteriors does not currently accept online payments via this Site.
• Final payment is due upon project completion unless otherwise agreed in writing.
• Unpaid balances may incur late fees or collection costs as permitted under Virginia law.

7. Warranties and Disclaimers

• RoofPro Exteriors provides workmanship warranties as stated in your written contract.
• Manufacturer warranties for roofing, siding, or gutter materials may apply; specific terms vary by product.
• Except as expressly stated in writing, services are provided “as is” without implied warranties of merchantability or fitness for a particular purpose.

We are not responsible for:

• Pre-existing conditions, structural deficiencies, or hidden damage.
• Subsequent alterations or third-party repairs.
• Normal wear, weathering, or natural product variations.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

• RVA HOME SERVICES GROUP AND ROOFPRO EXTERIORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, OR DATA.
• OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID UNDER THE RELEVANT SERVICE AGREEMENT OR (B) ONE HUNDRED DOLLARS ($100).

This limitation applies even if we were advised of the possibility of such damages.

9. Indemnification

You agree to indemnify and hold harmless RVA Home Services Group, RoofPro Exteriors, their employees, contractors, and affiliates from any losses, liabilities, damages, or costs (including attorney’s fees) resulting from:

• Your use or misuse of the Site or services;
• Your violation of these Terms; or
• Your breach of contract or violation of applicable law.

10. Intellectual Property

All website content, including text, images, graphics, and branding, is owned or licensed by RVA Home Services Group. No content may be copied, reproduced, or distributed without written consent.

11. User Content and Communications

By submitting reviews, photos, or testimonials, you grant RVA Home Services Group and RoofPro Exteriors a non-exclusive, royalty-free, perpetual license to use and display such content in marketing materials, social media, or project galleries. You affirm that you own or have permission to share all submitted materials.

12. Communication Consent

By providing your contact information, you agree that RoofPro Exteriors / RVA Home Services Group may contact you by phone, text, or email regarding project updates, estimates, or promotions. Message and data rates may apply. You may opt out by replying STOP or “Unsubscribe.”

13. Governing Law

These Terms, and any disputes arising from them, are governed by and construed under the laws of the Commonwealth of Virginia, without regard to conflicts of law principles.

14. Dispute Resolution

• Parties agree to first attempt resolution through good-faith negotiation for at least 30 days.
• If unresolved, disputes shall be submitted to binding arbitration administered by the American Arbitration Association in Richmond, Virginia.
• Arbitration shall be conducted on an individual basis; class actions and jury trials are waived.
• Small-claims court remains available for qualifying cases.

15. Termination and Suspension

We may suspend or terminate access to the Site at any time for violation of these Terms or misuse of the Site. Upon termination, your license to use the Site content immediately ceases.

16. Modifications to These Terms

We may update or modify these Terms at any time. Revisions take effect upon posting, and continued use of the Site signifies your acceptance of the updated Terms.

17. Entire Agreement

These Terms, together with our Privacy Policy and any executed service agreements, represent the complete agreement between you and RVA Home Services Group / RoofPro Exteriors regarding your use of the Site and our services.
